Revised proposal of the Russian Delegation (02/02/06)

Preamble

“q-bis) Reafirming that everyone, having duties to other individuals and to the community to which he or she belongs, is under a responsibility to strive for the promotion and observance of the rights recognized under the International Bill of Human Rights;”

(the proposed text is based on para.6 of the Preamble of the ICCPR)

Proposals made by the Russian Federation to the Chair's Text (MS Word)

The Delegation of the Russian Federation in Ad Hoc Committee would like to transmit herewith its proposals to some articles of the Draft Comprehensive and Integral International Convention on the Protection and Promotion of the Rights and Dignity of Persons with Disabilities (A/AC.265/2006/1):

Article 12, para.1

”Every person with disability have the right to recognition everywhere as person before law”.

Article 17-bis. Right to nationality.

“States Parties shall ensure that persons with disabilities are not deprived of their nationality, are not denied the right to acquire a nationality or to change their nationality, arbitrarily or on the basis of disability”.

Article 18. Freedom of movement

“1. States Parties shall recognize the rights of persons with disabilities to liberty of movement and freedom to choose their residence on an equal basis with others.

2. States Parties shall ensure, inter alia, that no person with disabilities is deprived, on the basis on disability, of his or her ability to posses and utilize documentation of identification, or to utilize relevant processes such as immigration proceedings, that may be needed to facilitate exercise of the right to liberty of movement.

3. States Parties shall take effective measures to ensure that persons with disabilities:

a) Are free to leave any country, including their own;
b) Are not arbitrarily deprived of their right to enter his own country”.

Rights of Children with Disabilities

Preamble.

”n-bis) Bearing in mind that disabled children, by reason both of their physical and mental immaturity and of their disability, especially when they are deprived of family environment, need appropriate safeguards and care, including legal protection, and recognizing that those guarantees shall be accorded, without any discrimination on the basis of disability, in accordance with the present Convention and other applicable rules of international law, set forth, inter alia, in the International Covenant on Civil and Political Rights, the International Covenant on Economic, Social and Cultural Rights and the Convention on the Rights of the Child;”.


Article 3. General principles.

“h) Full and harmonious development of every child with disability and respect of his or her identity and evolving capacities;”

 

[Article 7. Children with disabilities].

“1. States Parties shall respect and ensure the rights set forth in the Convention on the Rights of the Child and in this Convention to each child with disability on an equal basis with other children and without discrimination of any kind, including on the basis of disability.

2. Every child with disability shall have the right to such measures of protection, assistance and care, on the part of his or her family, society and the State, as required by his or her minor status and are tailored to his or her individual circumstances. When a child with disability is deprived of his or her family environment, or in whose own best interests cannot be allowed to remain in that environment, such protection and assistance shall be provided by the State.

3. In all actions concerning children with disabilities, whether undertaken by public or private social welfare institutions, courts, administrative or legislative bodies, the best interests of the child shall be a primary consideration.

4. In order to ensure full realization in good time of the rights in accordance with the present Convention, every child with disability shall be registered immediately after birth and shall have a name and the right to acquire a nationality on an equal basis with other children”.
