Article 17
PROTECTING THE INTEGRITY OF THE PERSON

 

 

 

Argentina, Brazil, Chile, Colombia, Costa Rica, Dominican Republic, Ecuador, El Salvador, Guatemala, Honduras, Mexico, Nicaragua, Panama, Paraguay, Peru, Uruguay and Venezuela

2 bis. States Parties shall prohibit, and protect persons with disabilities from, medical or scientific experimentation without the free and informed consent of the person concerned.

3. In cases of DEL: medical emergency or issues of risk to public health involving involuntary interventions, persons with disabilities shall be treated on an equal basis with others.

European Union

Replace Art.17 with:

States Parties shall protect the integrity of the person/persons with disabilities on a basis of equality with others and ensure that in no case shall the existence of disability justify an involuntary intervention or institutionalisation.

 

Japan

1. States Parties shall protect the integrity of the persons with disabilities on an equal basis with others, (ADD: and ensure that in no case shall the existence of disabilities justify an involuntary intervention or institutionalization).

2. DELETE

3. In cases of medical emergency or issues of risk to public health involving involuntary interventions, persons with disabilities shall be treated on an equal basis with others.

New Zealand

Replace text with: “Every person with a disability has a right to respect for his or her physical and mental integrity on an equal basis with others”
