Article 23
RESPECT FOR THE HOME AND THE FAMILY

 

 

Agreed language:

2. States Parties shall ensure the rights and responsibilities of persons with disabilities with regard to guardianship, wardship, trusteeship , [DEL and] adoption of children, or similar institutions…

 

Bangladesh

1(a): Persons with disabilities have the equal opportunity to conjugal life, under the existing permissible laws in respective States, and experience parenthood.

It is also recommended to replace the term ‘Right’ instead of ‘Respect’ in the heading of the article.

 

Canada

(1) States Parties shall take effective and appropriate measures to eliminate discrimination against persons with disabilities in all matters relating to marriage, family and personal relations, and shall ensure that [DELETE national] domestic laws, customs and traditions relating to marriage, family and personal relationships do not discriminate on the basis of disability so that:

(2) States Parties shall ensure the rights and responsibilities of persons with disabilities with regard to guardianship, wardship, trusteeship and adoption of children, or similar institutions where these concepts exist in national legislation; in all cases the BEST interests of the child [DELETE children] shall be paramount. States Parties shall render appropriate assistance to persons with disabilities in the performance of their child-rearing responsibilities.

 

China

New chapeau : States Parties shall recognize and take effective and appropriate measures to ensure the rights of persons with disabilities in all matters relating to marriage, family and personal relations on an equal basis with others in accordance with applicable national laws of general application, so that:

Para 1 c. Add the following words at the beginning of the sentence: “On equal basis with others,”

 

Colombia, El Salvador

1. States Parties shall take effective and appropriate measures to eliminate discrimination against persons with disabilities in all matters relating to marriage, family and personal relationships, and shall ensure that national laws, customs and traditions relating to marriage, family, personal relationships, sexuality and parenthood do not discriminate on the basis of disability so that.

(a) DELETE

 

Egypt, Morocco, Sudan, Syria, Saudi Arabia

1. States Parties shall take effective and appropriate measures to eliminate discrimination against persons with disabilities in all matters relating to marriage, family and personal relations in accordance with the national laws of general application so that:

1(a) DELETE: "experience their sexuality, have sexual and other intimate relationships".

 

European Union, Honduras

In paragraph 1 change the chapeau of the paragraph to read:

States Parties shall take effective and appropriate measures to eliminate discrimination against persons with disabilities in all matters relating to marriage, family, sexuality, personal relations and parenthood, and shall ensure that national laws, customs and traditions are not discriminatory so that:

And retain as 1. current paragraph (b) on marriage

2. current paragraph (c) on children

In the subparagraph (c) delete the term “age-appropriate” and change the end of the sentence to read: and the opportunity to retain their fertility on an equal basis with others”.

 

Jordan

1 a) Persons with disability have the equal opportunity to experience their sexual life in accordance with the national laws and the implemented regulations, and they have equal opportunities to experience their parenthood.

 

Kenya

1(c): ADD: “including children” after “equal opportunity”

3(a) Insert “a” before the word “provide”. 

4: ADD: “or be institutionalized” between the words “parent” and “on” in the last sentence.

 

Malaysia

1(a): DELETE.

 

Qatar on behalf of Bahrain, Kuwait, Oman, Saudi Arabia, Yemen, United Arab Emirates

To adopt one of the following options:

First: To delete clause (a) of item (1) which is related to the quoted Sexual Relations Practices and adding the phrase "Practicing the right of parenthood" to clause (b).

Second: To keep the clause and adding "according to the generally applied laws and traditions."
