Proposed the following added text to Art. 8(1) in order to reflect the important role of consultation with persons with disabilities and their representative organizations.
Such measures shall be undertaken in consultation with persons with disabilities and their representative organizations
EUROPEAN UNION
Article 8
EU Proposal: The EU considers that paragraph 2 dilutes the message of this article and considers that the language is patronising to persons with disabilities. For example, the State should not necessarily do the awareness-raising but should rather facilitate awareness-raising by persons with disabilities.
To produce a stronger, streamlined article, the EU therefore proposes the deletion of sub-paragraphs 1(c) and 2(a), (c) and (d) and proposes to move sub-paragraph 2(b) into paragraph 1, to become 1(c) (changing fostering to foster). The article would thus read:
1. States Parties undertake to adopt immediate and effective measures to:
(a) raise awareness throughout society regarding disability and persons with disabilities, and to foster respect for their rights;
(b) combat stereotypes and prejudices about persons with disabilities in all areas of life;
(c) foster at all levels of the education system, including in all children from an early age, an attitude of respect for the rights of persons with disabilities.

(a) raise awareness throughout society regarding disability and persons with disabilities, and to foster respect for their rights;
(b) combat stereotypes and prejudices about persons with disabilities in all areas of life;

relations of persons with disabilities;
(iii) promote recognition of the skills, merits, abilities and contributions of persons with disabilities to the workplace and the labour market;
(b) fostering at all levels of the education system, including in all children from an early age, an attitude of respect for the rights of persons with disabilities;
(c) encouraging all organs of the media to portray persons with disabilities in a manner consistent with the purpose of this Convention;
(d) promoting disability-sensitive awareness training programmes.

b) To combat stereotypes, prejudices and harmful practices relating to persons with disabilities including those based on gender in all areas of life;
2. Measures to this end include:
d) promoting awareness training programmes regarding people with disabilities and their rights taking into account gender specific aspects of disability.
INDIA
Intervention on Article 8
16.1.06 (Afternoon)
My delegation would support the retention of the Article as the attitude of society towards persons with Disabilities is very important to the realisation of their rights.
The language of the Article is also acceptable to us with one exception. We would support the delegations suggesting deletion of Para 2a(ii). However, we could be flexible on the retention but would urge the deletion of the word ‘sexuality’ on cultural consideration.

RAISING AWARENESS (REPLACE “REGARDING DISABILITY” BY “ON THE RIGHTS OF PERSONS WITH DISABILITIES”)
(JUSTIFICATION: The IDC would propose to reword the title which should include the reference to persons with disabilities (as subjects) and not to disability (as an object).)
1. States Parties undertake to adopt immediate and effective measures to:
(a) raise awareness throughout society regarding (DELETE “disability and”) persons with disabilities, and to foster respect for their rights;
(b) combat stereotypes and prejudices about persons with disabilities in all areas of life;
(c) promote awareness of the capabilities and contributions of persons with disabilities (ADD: “sharing the same rights and freedoms as others.”)
2. Measures to this end include:
(a) initiating and maintaining effective public awareness campaigns designed to:
(i) nurture receptiveness to the rights of persons with disabilities;
(ii) change negative perceptions and social prejudices towards persons with disabilities (DELETE: “in all matters of [sexuality,] marriage, parenthood and family relations of persons with disabilities;”)
(JUSTIFICATION: The IDC supports the need to change negative perceptions and social prejudices, but feels tat this should cover all areas of life, including (but not exclusively) those mentioned in subparagraph 2 (a) ii).
(iii) promote recognition of the skills, merits, abilities and contributions of persons with disabilities to the workplace and the labour market;
(b) fostering at all levels of the education system, including in all children from an early age, an attitude of respect for the rights of persons with disabilities;
(c) encouraging all organs of the media to portray persons with disabilities in a manner consistent with the purpose of this Convention;

(a) raise awareness throughout society regarding disability and persons with disabilities, and to foster respect for their rights;
(b) combat stereotypes and prejudices about persons with disabilities in all areas of life;
(b bis) not perpetuate gender stereotypes and stigmatisation;
(c) promote awareness of the capabilities and contributions of persons with disabilities.
2. Measures to this end include:
(a) initiating and maintaining effective public awareness campaigns designed to:
(i) nurture receptiveness to the rights of persons with disabilities;
(ii) change negative perceptions and social prejudices towards persons with disabilities in all matters of [sexuality,] marriage, parenthood and family relations of persons with disabilities;
(iii) promote recognition of the skills, merits, abilities and contributions of persons with disabilities to the workplace and the labour market;

IDCSK fully supports the proposals made by the IDC except only the below.

(Delete the whole article)
(JUSTIFICATION : We propose to delete the article 8 related to raising public awareness on disabled people. Rights of PWD should be respected as itself in that it cannot be guaranteed by public awareness raising. To mention public awareness in this convention may undermine the fact that human rights of PWD as human being should be respected and justified.
And also, guarantee of rights and public awareness raise cannot be compatible, so the article 8 on raising awareness is unnecessary in this Convention.
Particularly in the article 8, 1-(a) which says “raising awareness throughout society regarding persons with disabilities” and whole part of 1-(b), 1-(c), 2(a)-(ii), 2-(a)-(iii), 2(b) and 2(d) are inappropriate.
And if you remind the fact that CESCR, ICCPR, CEDAW and CRC don’t have any separate article regarding raising awareness, you may realize it’s not necessary for this convention alone to have separate article for awareness. And the way of thinking that this article is still necessary is no more than a typical sympathetic view on disabled people, which we have to be careful about. )
JAPAN DISABILITY FORUM (JDF)
Article 8 Raising awareness regarding disability Revision: The heading of Article 8 should be simply “Raising Awareness”.
Comment: Article 8 (Raising Awareness) of the Chairman’s text is for the most part acceptable. However, the term “sexuality” in Paragraph 2 (a) (ii) should be left in the Article.

(b) To combat stereotypes and prejudices about persons with disabilities in all areas of life;
(c) To promote awareness of the capabilities and contributions of persons with disabilities.
2. Measures to this end include:
(a) Initiating and maintaining effective public awareness campaigns designed:
(i) To nurture receptiveness to the rights of persons with disabilities;
(ii) To change negative perceptions and social prejudices towards persons with disabilities in all matters of [sexuality,] marriage, parenthood and family relations of persons with disabilities;
(iii) To promote recognition of the skills, merits, abilities and contributions of persons with disabilities to the workplace and the labour market;
(b) Fostering at all levels of the education system, including in all children from an early age, an attitude of respect for the rights of persons with
disabilities;
(c) Encouraging persons with disability to be makers of own media that would be included as attachments in media and all organs of the media to portray persons with disabilities in a manner consistent with the purpose of the present Convention; -

Justification:
We have gained experiences from developing a Promotion Voluntary Packet Program of Disability Mentoring Day (DMD), that includes campaigns regarding next goals and objectives: human rights to dignity of persons with disability (Valentines’ Day with focus on disabled people), women with disability (International Women Day 8th March with focus on women with disability), children with disability (International Children Day 1st June with focus on focus of disabled children) employment opportunities for persons with disability, inclusion in society and employment rights (third Wednesday in October – Main celebration of Disability Mentoring Day (DMD)) through which we were able to promote our human rights, freedom and abilities. Thus, the Promotion Packet Program of Campaigns is a year-round effort, which contains recognized International Campaigns with focus on persons with disability.
This Promotion Packet Program of Campaigns with focus on persons with disability should be a partnership with State, be responsive to public opinion for the purpose of promoting our goals and objectives contained in the Convention on the Rights of Persons with Disabilities.

Persons with disability should be active makers of own media that will be included as attachments in all kind of media. Persons with disability would be encouraged to promote purpose of the present Convention together with other media makers.
Exemplar:
Calendar is one of year-round efforts from the Promotion Packet Program of Campaigns, which contains recognized the purpose of the present Convention. We were able to make it by skills of disabled persons. It was advertised and delivered by our Newspaper Persons with Disability of Kosova as attachment in others daily newspapers.
